It provides access to our web and mobile applications.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">2.2. We reserve the right, temporarily or permanently, in whole or in part, to modify, suspend or discontinue the Application without notice for any reason without liability to you, except where prohibited by applicable law.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\"> 2.3. In addition, you acknowledge that the App is provided over the Internet and mobile networks and so the quality and availability of the App may be affected by factors outside our reasonable control. Accordingly, we do not accept any responsibility for any connectivity issues that you may experience when using the App. In addition, you acknowledge and agree that you (and not us) are responsible for obtaining and maintaining all telecommunications, broadband and computer hardware, equipment, and services needed to access and use the App, and for paying any data charges that may be charged to you by your network provider in connection with your use of the App. In the event you choose to share information from the App by utilizing SMS/text functionality, you acknowledge and agree that you (and not us) are responsible for paying any related fees that may be charged to you by your network or telecommunications provider.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">2.4. The Customer agrees to Foreigner Friendly Thailand of any changes to the data provided at the time of registration.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Except in the event of Foreigner Friendly Thailand Co. Ltd.'s own wrongdoing, or technical failure of the Service(s), the Customer will be responsible for the use of its email address, or other identifiers by third parties, or actions, or statements, made through the Customer’s communications with Foreigner Friendly Thailand, whether fraudulent or not, and will indemnify and hold Foreigner Friendly Thailand harmless against any claims in this respect. Furthermore, Foreigner Friendly Thailand is not required and does not have the technical means to ensure the identity of the persons registering for its Services. If a customer has reason to believe that a person is using their personal information, that Customer must immediately inform Foreigner Friendly Thailand Co. Ltd.’s policy of no “Dual Pricing” and its, “Fair Pricing Policy.”\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Foreigner Friendly Thailand also provide information and feedback from consumer customers, for other consumer customer’s and businesses, with its “Unique Review System”.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">To the best of our ability, monitor any breach of the Foreigner Friendly Thailand “Fair Pricing Policy”, via the process of our, “Report Dual Pricing” feature.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The purpose of the Services also does not cover the verification of the actual identity of Customers or businesses when they connect to the Site or Mobile App or to control the content and information provided by Customers and/or Businesses of their services. Foreigner Friendly Thailand is not responsible for any failure of the Customers or Businesses to provide accurate information.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">3.2. Ltd, and Businesses and all Customers.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Respect and not infringe on the intellectual property rights of the content provided by Foreigner Friendly Thailand and other Customers.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">This includes the unauthorized use of any trademark including Foreigner Friendly Thailand and its Customers.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Not reveal any information about its private life the dissemination of which could be harmful to the Customer or its reputation.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Not post publicly any negative comment that could in any way be harmful to the reputation of the Customer.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\"> 3.4  Essential Obligations\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The Customer’s Essential Obligations are as follows:\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Not to provide incorrect or misleading information regarding their personal data. \u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Not to post, disclose, or disseminate in any form whatsoever information or content that has the effect of diminishing, disrupting, preventing the normal use of the Services, interrupting and/or slowing the normal flow of communications between Customers and Foreigner Friendly Thailand through the Services, such as software, viruses, logical bombs, mass mailing, etc.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Not to provide email addresses or phone numbers to Foreigner Friendly Thailand of other persons or publish or send any information referring to other persons without having obtained their prior consent.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Only the Customer may use its personal information to access the Services. In this regard, the Customer will not, without this list being exhaustive, communicate, disseminate, share, make accessible, in any way whatsoever, its account information (including email account details) to any third party. Should a Customer wish to provide access to their Foreigner Friendly Thailand account to a third party, included but not limited to a friend, colleague or relative, the Customer will do so at their own risk.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">A breach of the Essential Obligations constitutes a serious breach by the Customer of its obligations. Without prejudice to the provisions of the Article entitled “Termination”, in the event a customer failing to fulfil one or more of these Essential Obligations, Foreigner Friendly Thailand may terminate the contract and permanently delete the Customer’s account(s) on the Site and Mobile App and Services without refund.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">To use the Services in accordance with the purpose described in the Terms of Use.\u003C/span>\u003C/p>\r\n\u003Ch5 class=\"MsoNormal\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cstrong>\u003Cspan lang=\"EN-US\">4. Customers may make a Purchase via the payment method outlined, and on display, on the applicable payment page when making a purchase.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">They must be the account holder and duly authorized to make such payment.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The fees and Booking Conditions for these various Paid Services are always available during the introduction or use of the Paid Service(s) to which the Customer wishes to subscribe as well as its (or their) respective rate(s).\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Fees are quoted in Thai Baht. The purchase  by a Customer is virtually instantaneous from the validation of the transaction by Bank Card.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cstrong>\u003Cspan lang=\"EN-US\"> 5. Any other use by the Customer is prohibited.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The Customer is prohibited from, among other actions, modifying, copying, reproducing, downloading, broadcasting, transmitting, commercially operating and/or distributing the Services, Site pages or the computer code of the Services and Sites, in any way whatsoever.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">5.2. Ltd, a license to use the intellectual property rights arising from the content provided by Customers in, and connection with, their registration, and use of the Services. This license includes, but is not limited to, the right of Foreigner Friendly Thailand Co. Ltd,  to reproduce, represent, adapt, translate, digitize, and use for the purposes of the Services, or sub-license the content provided by the Customer (information, images, description, etc.) on all or part of the Services (on the Site or Mobile App, by email) and  in the mailing campaigns carried out by Foreigner Friendly Thailand Co. Ltd, and, in general, on all electronic communication media (email, SMS, MMS, WAP, Internet, mobile application) as part of the Services.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cspan lang=\"EN-US\">The Customer expressly authorizes Foreigner Friendly Thailand Co. Ltd to modify this content to comply with the graphic charter of the Services or other communication media referred to above, and/or to bring it into compatibility with its technical functionality or the formats of the media in question. These rights are granted worldwide and for the duration of the Terms of Use between the Customer and Foreigner Friendly Thailand. Ltd, does not guarantee that the Services will be able to be used if Customers use a “pop-up blocker” tool; in this case, this function must be disabled prior to the use of the Services.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Foreigner Friendly Thailand Co. Ltd, does not warrant that the Services will function properly if the Customer’s Internet service provider fails to provide an adequate level of service. Similarly, if applicable, the use of smartphone applications, whose use Customers have agreed on directly with the provider, requires Customers to have a smartphone and a satisfactory connection.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Under these circumstances, Foreigner Friendly Thailand Co. Ltd, is not responsible for any lack of functionality, lack of access, or poor conditions of use of the Sites, that would be attributable to equipment-related inadequacies, to the internal failures of Customers’ access provider, the overloading of the Internet network and for all other reasons external to Foreigner Friendly Thailand, which the Customer agrees are events of force majeure.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cspan lang=\"EN-US\">The operation of the Services may be interrupted momentarily due to maintenance, updates, or technical improvements, or to update the content and/or the way it is presented. To the extent possible, Foreigner Friendly Thailand will, if possible, notify their Customer prior to any maintenance operations or updates.\u003C/span>\u003Cspan lang=\"EN-US\">‍\u003C/span>\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\"> 6.2. Information and content provided by Customers\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Information provided by a Customer to Foreigner Friendly Thailand Co. Ltd must be accurate and true. A Customer may disclose information voluntarily and the consequences that disclosing this information may have on the Customer’s life or the lives of other Customers are the exclusive responsibility of the Customer in question. The Customer, on its own account, discloses and disseminates information, data, texts, content, and images that concern it through the Services.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Accordingly, the Customer waives the right to make any claim against Foreigner Friendly Thailand Co. Ltd, especially on the basis of the possible infringement of its image rights, honor, reputation or privacy of its private life, that may result from the distribution or dissemination of information that concerns it under the terms and conditions established in the Terms of Use, in particular the Privacy Policy, to the extent that the Customer has previously given its voluntary and express consent to such dissemination as a result of its registration with the Services and in application of the Terms of Use.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Foreigner Friendly Thailand Co. Ltd cannot be held liable for the accuracy or inaccuracy of the information and content provided by other Customers, visitors to the Sites and/or the Customer itself (and the consequences of reliance on any such information). Similarly, Foreigner Friendly Thailand  Co. Ltd cannot be held liable for any content used by a Customer that may potentially constitute a breach of the rights, of one or more of the other Customers or third parties, where a Customer of Foreigner Friendly Thailand Co. Ltd can demonstrate that it: (i) was not informed by a Customer or third party, or about the content or the use, (ii) did not have actual or prior knowledge of the same or (iii) did not commit a breach in the performance of any of its contractual obligations which led to such content being used.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Foreigner Friendly Thailand Co. Ltd may only be held liable by a customer if there is proof that Foreigner Friendly Thailand deliberately and intentionally committed a breach of its obligations, and this breach has caused the Customer direct damage. Where appropriate, it will be Foreigner Friendly Thailand Co. Ltd.’s responsibility to demonstrate that it has not committed any intentional breaches in the performance of its contractual obligations. Foreigner Friendly Thailand Co. Ltd may not be held liable for any direct or indirect damage incurred by the Customer in the event the Customer causes the damage or the damage results from an event of force majeure.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The quality of the Services demanded by both Foreigner Friendly Thailand Co. Ltd and its Customers requires that Customers conduct themselves ethically and behave with respect for the rights of third parties, and the respect for the laws of Thiland and regulations in force. To meet this demand for quality, individual responsibility and ethics, Foreigner Friendly Thailand requests any Customer to report any data (photography, text, video), behaviors or comments made by another Customer that appear to be in violation of the laws and regulations in force, concerning the purpose of the Services, third-party rights, or public morals.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\"> As a result, Customers acknowledge and accept that the data they provide, as well as their behavior or comments made through the Services, may be reported by other Customers or End Users and are subject to acts of moderation and/or oversight by Foreigner Friendly Thailand Co. Ltd based on objective assessment criteria. If Foreigner Friendly Thailand Co. Ltd’s investigation of a report reveals that a customer violated the laws and regulations in force or its contractual obligations, the provisions of the Terms of Use, in particular, item 8 entitled “Termination”, may be applied. Depending on the Customers’ behavior or the comments made by Customers, the monitoring team reserve the right to block  a Customer that has been the subject of a complaint.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">In the event Foreigner Friendly Thailand Co. Ltd is held liable based on a customer breach of its legal obligations or those under the Terms of Use, said Customer agrees to indemnify and hold Foreigner Friendly Thailand Co. Ltd harmless against any orders, and all legal costs issued against it resulting from the Customer’s breach of its obligations.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\"> 6.3. Ltd of the request to close the account concerned and the account will be deleted no later than fourteen (14) days after the receipt of the request by Foreigner Friendly Thailand. This request will not entail reimbursement to the Customer of any kind.\u003C/span>\u003C/p>\r\n\u003Ch5 class=\"MsoNormal\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cstrong>\u003Cspan lang=\"EN-US\">8. Termination\u003C/span>\u003C/strong>\u003C/span>\u003C/h5>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">Without prejudice to the other provisions of the Terms of Use, in the event of a serious breach of the Terms of Use by the Customer, Foreigner Friendly Thailand Co. Ltd will terminate the Customer’s account without prior notice or formal notice. Ltd and/or, its successors as a result of these breaches.\u003C/span>\u003C/p>\r\n\u003Cp class=\"MsoNormal\" style=\"mso-layout-grid-align: none; text-autospace: none;\">\u003Cspan lang=\"EN-US\" style=\"font-family: arial, helvetica, sans-serif;\">The Customer will be notified by email of the termination or confirmation of the termination of its account. A ‘Virtual Tour” is a feature available to businesses that gives the ability to add additional imagery and video content of your business to better attract consumer users to your service/product offering. The content you provide will be uploaded to the Foreigner Friendly Thailand YouTube channel. The ‘Virtual Tour” for your businesses will be accessible to consumer members via a hyperlink to your content on our channel that is embedded into your business listing profile page. By providing imagery, or video content for your company’s, ‘Virtual Tour’ on your business profile listing, you are giving Foreigner Friendly Thailand Co. Ltd permission and consent to distribute this content via Foreigner Friendly Thailand’s YouTube channel for the purpose of promoting your business.\u003C/span>\u003C/p>\r\n\u003Ch5 class=\"MsoNormal\">\u003Cspan style=\"font-family: arial, helvetica, sans-serif;\">\u003Cspan lang=\"EN-US\"> \u003C/span>\u003Cstrong>\u003Cspan lang=\"EN-US\">10. However, by completing the ‘Report Dual Pricing’ form, and submitting substantiating, compelling evidence, Foreigner Friendly Thailand Co. Partner(s)” หมายถึง ธุรกิจทั้งหมดที่ให้บริการแก่ลูกค้าของฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ตัวแทน หมายถึงธุรกิจหรือบุคคลที่ส่งเสริมธุรกิจตัวแทนโฆษณาออนไลน์ของเรา “เว็บไซต์” หมายถึงเว็บไซต์และแอปพลิเคชันมือถือ Foreigner Friendly อย่างใดอย่างหนึ่งหรือทั้งหมด “การยกระดับ” หมายถึงส่วนเพิ่มที่ชำระเงินแล้ว ตามคำขอของลูกค้า สำหรับบริการเพิ่มเติมในการซื้อ “ผู้เข้าชม” หมายถึงผู้ใช้หนึ่งรายขึ้นไปที่เข้าถึงเว็บไซต์หรือแอปพลิเคชัน “เงื่อนไขการใช้งาน” หมายถึงสัญญาฉบับนี้ 2. การเข้าถึงและการลงทะเบียนใช้บริการ 2.1 เวลาที่ลงทะเบียนยกเว้นในกรณีที่ Foreigner Friendly Thailand กระทำความผิดเองหรือการให้บริการมีปัญหาทางเทคนิค ลูกค้าจะต้องรับผิดชอบต่อการใช้ที่อยู่อีเมล์ของตนหรือตัวระบุอื่น ๆ โดยบุคคลภายนอกหรือการกระทำหรือข้อความที่ทำผ่านการสื่อสารของลูกค้ากับฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่ว่าจะหลอกลวงหรือไม่ก็ตาม และจะชดใช้ค่าเสียหายและปกป้อง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จากการเรียกร้องใด ๆ ในส่วนนี้ นอกจากนี้ Foreigner Friendly Thailand ไม่จำเป็นต้องมีและไม่มีวิธีการทางเทคนิคในการตรวจสอบตัวตนของบุคคลที่ลงทะเบียนใช้บริการ หากลูกค้ามีเหตุผลที่จะเชื่อได้ว่าบุคคลใดใช้ข้อมูลส่วนบุคคลของตน ลูกค้ารายนั้นจะต้องแจ้งให้ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ทราบทันที 2.2 เงื่อนไขการเข้าถึงและการลงทะเบียนแบบชำระเงิน ลูกค้าสามารถที่จะทำการซื้อแบบชำระเงินและจะได้รับประโยชน์จากคุณลักษณะเด่นดังต่อไปนี้ คุณลักษณะเด่นในการบริการที่มีให้สำหรับลูกค้า (รวมถึงลูกค้าที่มีบัญชีแบบไม่เสียค่าใช้จ่าย) สร้างข้อมูลส่วนบุคคล คุณลักษณะเด่นที่มีให้สำหรับลูกค้าที่ซื้อเท่านั้น เข้าถึง Flash Promotion เข้าถึงส่วนลด ตามข้อเสนอจากธุรกิจและสิ่งจูงใจอื่น ๆ ที่อาจมีเป็นครั้งคราว 3.1 ภาระผูกพันของฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand ) วัตถุประสงค์ของบริการนี้มีขึ้นเพียงเพื่อให้ลูกค้าของแพลตฟอร์ม Foreigner Friendly Thailand ทราบข้อมูลและบริการของธุรกิจที่สมัครรับนโยบายไม่มี “การกำหนดราคาโดยที่ให้ราคาที่จำหน่ายในประเทศมีความแตกต่างจากราคาที่ขายในต่างประเทศ” และ “นโยบายการกำหนดราคาอย่างเป็นธรรม” ของฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ยังให้ข้อมูลและคำติชมจากลูกค้ากลุ่มธุรกิจด้วย “ระบบตรวจสอบเฉพาะ” วัตถุประสงค์ของบริการยังไม่ครอบคลุมถึงการตรวจสอบตัวตนที่แท้จริงของลูกค้าหรือธุรกิจเมื่อพวกเขาเชื่อมต่อกับเว็บไซต์หรือแอปพลิเคชันมือถือหรือควบคุมเนื้อหาและข้อมูลที่ลูกค้าและ/หรือธุรกิจที่ให้บริการของพวกเขา ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะไม่รับผิดชอบต่อการไม่สามารถให้ข้อมูลที่ถูกต้องของลูกค้าหรือธุรกิจ 3.2 ภาระผูกพันของลูกค้า ข้อกำหนดของข้อนี้ยังมีผลบังคับใช้โดยไม่กระทบต่อหัวข้อเรื่อง “การยุติ” ในการใช้บริการ ลูกค้าตกลงที่จะปฏิบัติตามกฎหมายของประเทศไทย และเคารพสิทธิ์ของบุคคลที่สามและข้อกำหนดของเงื่อนไขการใช้งาน 3.3 ภาระผูกพันทั่วไป ภาระผูกพันทั่วไปของลูกค้ามีดังนี้ ประพฤติตนด้วยความซื่อสัตย์สุจริตต่อฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand)และธุรกิจและลูกค้าทุกคน เคารพและไม่ละเมิดสิทธิ์ในทรัพย์สินทางปัญญาของเนื้อหาที่จัดทำโดยฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และลูกค้ารายอื่น ซึ่งรวมถึงการใช้เครื่องหมายการค้าใด ๆ รวมถึง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และลูกค้าโดยไม่ได้รับอนุญาต ไม่เปิดเผยข้อมูลใด ๆ เกี่ยวกับชีวิตส่วนตัว การเผยแพร่ดังกล่าวอาจเป็นอันตรายต่อลูกค้าหรือชื่อเสียงของบริษัท ไม่แสดงความคิดเห็นเชิงลบใด ๆ ต่อสาธารณะที่อาจเป็นอันตรายต่อชื่อเสียงของลูกค้า 3.4 ภาระผูกพันที่สำคัญ ภาระผูกพันที่สำคัญของลูกค้ามีดังนี้ ไม่ให้ข้อมูลที่ไม่ถูกต้องหรือทำให้เข้าใจผิดเกี่ยวกับข้อมูลส่วนบุคคลของพวกเขา ไม่ประกาศ เปิดเผย หรือเผยแพร่ข้อมูลหรือเนื้อหาในรูปแบบใด ๆ ที่มีผลทำให้การใช้บริการตามปกติลดลง ถูกรบกวน หรือถูกขัดขวาง หรือทำให้เกิดการขัดจังหวะและ/หรือชะลอการสื่อสารตามปกติระหว่างลูกค้าและ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ผ่านทางบริการต่าง ๆ เช่น ซอฟต์แวร์ ไวรัส ระเบิดเวลา การส่งอีเมลจำนวนมาก ฯลฯ ไม่ให้ที่อยู่อีเมลหรือหมายเลขโทรศัพท์ของบุคคลอื่นกับ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) หรือเผยแพร่หรือส่งข้อมูลใด ๆ ที่อ้างถึงบุคคลอื่นโดยไม่ได้รับการยินยอมล่วงหน้า ใช้บริการตามวัตถุประสงค์ที่อธิบายไว้ในเงื่อนไขการใช้งาน เฉพาะลูกค้าเท่านั้นที่สามารถใช้ข้อมูลส่วนบุคคลเพื่อเข้าถึงบริการ ในการนี้ ลูกค้าจะไม่ติดต่อสื่อสาร เผยแพร่ แบ่งปัน ทำให้เข้าถึงได้ ไม่ว่าด้วยวิธีใด ต่อข้อมูลบัญชีของตน (รวมถึงรายละเอียดบัญชีอีเมล) กับบุคคลภายนอก หากลูกค้าต้องการให้บุคคลภายนอกเข้าถึงบัญชีฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand)ของตน ซึ่งรวมถึงแต่ไม่จำกัดเพียงเพื่อน เพื่อนร่วมงาน หรือญาติ ลูกค้าจะต้องรับความเสี่ยงเอง การฝ่าฝืนภาระผูกพันที่สำคัญถือเป็นการละเมิดข้อผูกพันของลูกค้าอย่างร้ายแรง โดยไม่กระทบต่อข้อกำหนดของหัวข้อเรื่อง “การยุติ” ในกรณีที่ลูกค้าไม่ปฏิบัติตามข้อผูกพันที่สำคัญเหล่านี้อย่างน้อยหนึ่งข้อฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) อาจยุติสัญญาและลบบัญชีของลูกค้าบนเว็บไซต์และแอปพลิเคชันมือถือและการให้บริการอย่างถาวรโดยไม่มีการคืนเงิน 4. ค่าธรรมเนียมและเงื่อนไขการชำระเงิน 4.1 ค่าธรรมเนียม เงื่อนไข และเงื่อนไขการชำระเงิน การใช้บริการแบบชำระเงินสามารถทำได้เฉพาะเมื่อลูกค้ายกระดับเป็นลูกค้าแบบชำระเงินหรือหากพวกเขาเป็นธุรกิจที่ชำระค่าโฆษณาบนแพลตฟอร์ม ลูกค้าสามารถทำการซื้อด้วยบัตรของธนาคารหรือแอปพลิเคชันมือถือ การซื้อโดยลูกค้าแทบจะเกิดขึ้นทันทีจากการตรวจสอบความถูกต้องของธุรกรรมด้วยบัตรธนาคาร 5. ทรัพย์สินทางปัญญา 5.1 เนื้อหาที่เผยแพร่ในบริการ ชื่อบริการ เครื่องหมายการค้า เครื่องหมาย กราฟิก แอนิเมชั่น วิดีโอ และข้อความที่มีอยู่ในเว็บไซต์และภายในบริการทั้งหมดเป็นทรัพย์สินของ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) (เว้นแต่จะระบุไว้เป็นอย่างอื่น) และห้ามทำซ้ำ ใช้ หรือแสดงโดยไม่ได้รับอนุญาต ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) สิทธิ์ในการใช้งานที่มอบให้กับลูกค้านั้นจำกัดเฉพาะการใช้งานเฉพาะรายและส่วนบุคคลโดยเป็นส่วนหนึ่งของและตลอดระยะเวลาของการลงทะเบียนสำหรับบริการ การใช้งานอื่นใดโดยลูกค้าเป็นสิ่งต้องห้าม ห้ามมิให้ลูกค้าดำเนินการแก้ไข คัดลอก ทำซ้ำ ดาวน์โหลด ออกอากาศ ส่งต่อ ดำเนินการในเชิงพาณิชย์และ/หรือแจกจ่ายบริการ หน้าเว็บไซต์ หรือรหัสคอมพิวเตอร์ของบริการและเว็บไซต์ ไม่ว่าด้วยวิธีใด ๆ ก็ตาม 5.2 เนื้อหาที่ใช้และแบ่งปัน ลูกค้าอนุญาตให้ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ใช้สิทธิ์ในทรัพย์สินทางปัญญาที่เกิดจากเนื้อหาที่ลูกค้าให้ไว้และเกี่ยวข้องกับการลงทะเบียนและการใช้บริการ การอนุญาตนี้รวมถึง แต่ไม่จำกัดเพียง สิทธิของ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand)ในการผลิตซ้ำ นำเสนอ ดัดแปลง แปล แปลงเป็นดิจิทัล และใช้เพื่อวัตถุประสงค์ของบริการ หรือให้อนุญาตช่วงต่อเนื้อหาที่ลูกค้าให้มา (ข้อมูล รูปภาพ คำอธิบาย ฯลฯ) ในทั้งหมดหรือบางส่วนของบริการ (บนเว็บไซต์หรือแอปพลิดคชันมือถือ ทางอีเมล) และในแคมเปญทางไปรษณีย์ที่ดำเนินการโดย ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และโดยทั่วไปในสื่อการสื่อสารอิเล็กทรอนิกส์ทั้งหมด (อีเมล SMS MMS WAP อินเทอร์เน็ต แอปพลิเคชันมือถือ) ซึ่งเป็นส่วนหนึ่งของบริการ ลูกค้าอนุญาตโดยชัดแจ้งให้ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) แก้ไขเนื้อหานี้เพื่อให้เป็นไปตามกฎบัตรกราฟิกของบริการหรือสื่อการสื่อสารอื่น ๆ ที่อ้างถึงข้างต้น และ/หรือเพื่อให้เข้ากันได้กับการทำงานทางเทคนิคหรือรูปแบบของสื่อที่เป็นปัญหา สิทธิ์เหล่านี้มอบให้ทั่วโลกและตลอดระยะเวลาของเงื่อนไขการใช้งานระหว่างลูกค้าและฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ลูกค้าไม่สามารถคัดลอก ทำซ้ำ หรือใช้เนื้อหาที่สร้างโดยลูกค้ารายอื่น นอกเหนือจากวัตถุประสงค์ที่เข้มงวดในการใช้บริการเพื่อวัตถุประสงค์ส่วนบุคคลและเฉพาะราย 6. การรับประกัน ความรับผิดชอบและคำรับรอง 6.1 การทำงานของเว็บไซต์และบริการ ในการใช้บริการ ลูกค้าต้องมีอุปกรณ์ ซอฟต์แวร์ และพารามิเตอร์ที่จำเป็นสำหรับการทำงานที่ถูกต้องของบริการ รวมถึงรุ่นล่าสุดของเบราว์เซอร์อินเทอร์เน็ตที่อนุญาตให้ใช้คุกกี้และยอมรับป๊อปอัป การเชื่อมต่อกับเว็บไซต์ของเราอาจเป็นไปไม่ได้ขึ้นอยู่กับการกำหนดค่าเครือข่ายของท่าน (ป้องกันโดยไฟร์วอลล์หรือพร็อกซี)ลูกค้าต้องมีความสามารถ วัสดุและซอฟต์แวร์ที่จำเป็นสำหรับการใช้อินเทอร์เน็ตหรือแอปพลิเคชันมือถือของบริการ (ถ้ามี) บริการอินเทอร์เน็ต และรับทราบว่าลักษณะและข้อจำกัดของอินเทอร์เน็ตไม่รับประกันความปลอดภัย ความพร้อมใช้งาน และความสมบูรณ์ของการส่งข้อมูลทางอินเทอร์เน็ตหรือผ่านแอปพลิเคชั่นมือถือ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่รับประกันว่าจะใช้บริการได้หากลูกค้าใช้เครื่องมือ “ตัวบล็อกป็อปอัพ” ในกรณีนี้ ฟังก์ชันนี้จะต้องปิดใช้งานก่อนที่จะใช้บริการ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่รับประกันว่าบริการจะทำงานอย่างถูกต้องหากผู้ให้บริการอินเทอร์เน็ตของลูกค้าไม่สามารถให้บริการในระดับที่เพียงพอ ในทำนองเดียวกัน หากเป็นไปได้ การใช้แอปพลิเคชันในสมาร์ทโฟน ซึ่งเป็นการใช้งานที่ลูกค้าได้ตกลงกับผู้ให้บริการโดยตรง ลูกค้าต้องมีสมาร์ทโฟนและการเชื่อมต่อที่เพียงพอ ภายใต้สถานการณ์เหล่านี้ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะไม่รับผิดชอบต่อการไม่สามารถใช้งานได้ การไม่สามารถเข้าถึงได้ หรือสภาพการใช้งานที่ไม่ดีของเว็บไซต์อันเนื่องมาจากความไม่เพียงพอที่เกี่ยวข้องกับอุปกรณ์ ต่อความล้มเหลวภายในของผู้ให้บริการการเข้าถึงของลูกค้า การโอเวอร์โหลดของเครือข่ายอินเทอร์เน็ตและด้วยเหตุผลอื่น ๆ ภายนอกต่อฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ซึ่งลูกค้ายอมรับว่าเป็นเหตุสุดวิสัย การทำงานของบริการอาจถูกขัดจังหวะชั่วขณะอันเนื่องมาจากการบำรุงรักษา การปรับปรุง หรือการปรับปรุงทางเทคนิค หรือการปรับปรุงเนื้อหาและ/หรือวิธีการนำเสนอ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะแจ้งให้ลูกค้าของตนทราบก่อนดำเนินการบำรุงรักษาหรือการปรับปรุงข้อมูลใด ๆ เท่าที่จะเป็นไปได้ 6.2 ข้อมูลและเนื้อหาที่ลูกค้ามอบให้ ข้อมูลที่ลูกค้ามอบให้กับฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะต้องถูกต้องและเป็นความจริง ลูกค้าอาจเปิดเผยข้อมูลด้วยความสมัครใจและผลที่ตามมาของการเปิดเผยข้อมูลนี้ที่อาจมีผลต่อชีวิตของลูกค้าหรือชีวิตของลูกค้ารายอื่นถือเป็นความรับผิดชอบของลูกค้าแต่เพียงผู้เดียว ในบัญชีของตนเอง ลูกค้าจะเปิดเผยและเผยแพร่ข้อมูล ข้อความ เนื้อหา และรูปภาพที่เกี่ยวข้องผ่านบริการได้ ดังนั้น ลูกค้าจึงสละสิทธิ์ในการเรียกร้องใด ๆ กับ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ซึ่งอาจเป็นผลมาจากการกระจายหรือเผยแพร่ข้อมูลที่เกี่ยวข้องกับข้อกำหนดและเงื่อนไขที่กำหนดไว้ในเงื่อนไขการใช้งาน โดยเฉพาะอย่างยิ่งนโยบายความเป็นส่วนตัว Thailand) ไม่สามารถรับผิดชอบต่อความถูกต้องหรือความไม่ถูกต้องของข้อมูลและเนื้อหาที่ลูกค้ารายอื่น ผู้เข้าชมเว็บไซต์และ/หรือตัวลูกค้าเองมอบให้ (และผลที่ตามมาของการใช้ข้อมูลดังกล่าว) ในทำนองเดียวกัน ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะไม่รับผิดชอบต่อเนื้อหาใด ๆ ที่ลูกค้าใช้ซึ่งอาจเป็นการละเมิดสิทธิ์ของลูกค้ารายอื่นหรือบุคคลภายนอก ซึ่งลูกค้าของฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) สามารถพิสูจน์ว่า (1) ไม่ได้รับแจ้งจากลูกค้าหรือบุคคลภายนอก หรือเกี่ยวกับเนื้อหาหรือการใช้งาน (2) ไม่มีความรู้อย่างแท้จริงหรือความรู้ก่อนประสบการณ์เกี่ยวกับสิ่งเดียวกันหรือ (3) ไม่ได้กระทำการละเมิดในการปฏิบัติตามสัญญาใด ๆ ภาระผูกพันที่นำไปสู่การใช้เนื้อหาดังกล่าว ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะรับผิดต่อลูกค้าก็ต่อเมื่อมีหลักฐานว่าฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ละเมิดภาระผูกพันโดยจงใจและโดยเจตนา และการละเมิดนี้ได้ก่อให้เกิดความเสียหายโดยตรงต่อลูกค้า ในกรณีที่เหมาะสม จะเป็นความรับผิดชอบของ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ในการพิสูจน์ว่าไม่ได้กระทำความผิดโดยเจตนาในการปฏิบัติตามภาระผูกพันตามสัญญา ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะไม่รับผิดชอบต่อความเสียหายโดยตรงหรือโดยอ้อมใด ๆ ที่เกิดขึ้นโดยลูกค้าในกรณีที่ลูกค้าก่อให้เกิดความเสียหายหรือผลของความเสียหายที่เกิดจากเหตุสุดวิสัย คุณภาพของบริการที่เป็นที่ต้องการของทั้ง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และลูกค้านั้นกำหนดให้ลูกค้าต้องปฏิบัติตนอย่างมีจริยธรรมและประพฤติตนด้วยความเคารพต่อสิทธิของบุคคลภายนอก และเคารพต่อกฎหมายของประเทศไทยและกฎระเบียบที่บังคับใช้ เพื่อตอบสนองความต้องการด้านคุณภาพ ความรับผิดชอบส่วนบุคคล และจริยธรรมนี้ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ขอให้ลูกค้ารายงานข้อมูลใด ๆ (ภาพถ่าย ข้อความ วิดีโอ) พฤติกรรมหรือความคิดเห็นของลูกค้ารายอื่นที่ดูเหมือนว่าจะละเมิดกฎหมายและกฎระเบียบที่บังคับใช้ เกี่ยวกับวัตถุประสงค์ของบริการ สิทธิ์ของบุคคลภายนอก หรือศีลธรรมอันดีของประชาชน ด้วยเหตุนี้ ลูกค้ารับทราบและยอมรับว่าข้อมูลที่มอบให้ ตลอดจนพฤติกรรมหรือความคิดเห็นที่แสดงผ่านบริการ อาจถูกรายงานโดยลูกค้ารายอื่นหรือผู้ใช้ขั้นปลายและอยู่ภายใต้การควบคุมและ/หรือการดูแลโดย ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ตามเกณฑ์การประเมินวัตถุประสงค์ หากการตรวจสอบการรายงานของ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) พบว่าลูกค้าละเมิดกฎหมายและกฎระเบียบที่บังคับใช้หรือภาระผูกพันตามสัญญา ข้อกำหนดของเงื่อนไขการใช้งาน โดยเฉพาะ ข้อ 8 หัวข้อ “การยุติ” อาจถูกนำมาบังคับใช้ ทีมตรวจสอบขอสงวนสิทธิ์ในการบล็อกลูกค้าที่ได้รับการร้องเรียน ทั้งนี้ขึ้นอยู่กับพฤติกรรมของลูกค้าหรือการแสดงความคิดเห็นของลูกค้า ในกรณีที่ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ต้องรับผิดจากการที่ลูกค้าละเมิดภาระผูกพันทางกฎหมายหรือเงื่อนไขการใช้งาน ลูกค้ารายดังกล่าวตกลงที่จะชดใช้ค่าเสียหายและปกป้อง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จากคำสั่งใด ๆ และค่าใช้จ่ายทางกฎหมายทั้งหมดที่เกิดจากการละเมิดภาระผูกพันของลูกค้า 6.3 ลิงค์และแหล่งข้อมูลภายนอก ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะรับผิดชอบเฉพาะไฮเปอร์ลิงก์ที่สร้างขึ้นและไม่ได้ใช้การควบคุมใด ๆ ต่อเว็บไซต์ภายนอกและทรัพยากรภายนอก (เว็บไซต์หรือแอปพลิเคชันมือถือของบุคคลภายนอก เครือข่ายสังคมออนไลน์ ฯลฯ) ซึ่งไฮเปอร์ลิงก์สามารถเข้าถึงได้บนเว็บไซต์และการให้บริการที่เปลี่ยนเส้นทางและที่ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่ได้สร้าง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่สามารถรับผิดชอบต่อการจัดหาไฮเปอร์ลิงก์ไปยังเว็บไซต์ภายนอก และไม่สามารถรับผิดชอบต่อเนื้อหา โฆษณา ผลิตภัณฑ์ คุณลักษณะเด่นของการบริการหรือข้อมูลอื่นใดที่มีอยู่บนหรือตามการใช้งานเว็บไซต์ภายนอกดังกล่าว ปัญหาใด ๆ ที่เกี่ยวข้องกับลิงค์จะต้องส่งไปยังผู้ดูแลระบบหรือเว็บมาสเตอร์ของเว็บไซต์ที่เป็นปัญหา การเข้าถึงของลูกค้าและ/หรือการใช้แหล่งข้อมูลเหล่านี้และเว็บไซต์ภายนอกอาจอยู่ภายใต้ข้อกำหนดและเงื่อนไขของบุคคลภายนอกซึ่ง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ไม่มีอำนาจควบคุม โดยสรุป หากในระหว่างการใช้เว็บไซต์ การใช้เว็บไซต์นำลูกค้าไปยังเพจที่มีเว็บไซต์ภายนอก เพจ หรือฟอรัมที่มีชื่อและ/หรือเนื้อหาที่ถือเป็นการละเมิดกฎหมายที่บังคับใช้ ลูกค้าจะถูกขอให้ยุติการใช้เว็บไซต์ หรือการนำทางไปยังเว็บไซต์ภายนอกที่เป็นปัญหา ลูกค้าที่ยังคงค้นหา หรือนำทางไปยังเว็บไซต์ภายนอกดังกล่าวจะต้องรับความเสี่ยงเอง และ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะไม่รับผิดชอบต่อเนื้อหาของเว็บไซต์ภายนอก 6.4 การชดใช้ค่าเสียหาย ท่านตกลงที่จะชดใช้ค่าเสียหายแก่เรา (รวมถึงกรรมการ เจ้าหน้าที่ พนักงาน ผู้รับเหมาช่วง ตัวแทน และบริษัทในเครือ) ต่อการเรียกร้องและความรับผิดของบุคคลภายนอกทั้งหมดที่เกี่ยวข้องกับการละเมิดข้อตกลงนี้และ/หรือการใช้บริการของท่าน 7. การปิดบัญชี ลูกค้าสามารถขอปิดบัญชีฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ได้ตลอดเวลาโดยติดต่อ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) คำขอนี้จะถือว่าทำในวันทำการถัดไปหลังจากฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ได้รับคำขอให้ปิดบัญชีและบัญชีจะถูกลบออกภายในสิบสี่ (14) วันหลังจาก ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) ได้รับคำขอ คำขอนี้จะไม่ส่งผลถึงการชำระเงินคืนแก่ลูกค้าไม่ว่าในรูปแบบใด ๆ โดยไม่กระทบต่อข้อกำหนดอื่น ๆ ของเงื่อนไขการใช้งาน ในกรณีที่ลูกค้าละเมิดเงื่อนไขการใช้งานอย่างร้ายแรง ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) จะยุติบัญชีของลูกค้าโดยไม่ต้องแจ้งให้ทราบล่วงหน้าหรือแจ้งให้ทราบอย่างเป็นทางการ การยุตินี้จะมีผลเช่นเดียวกับการยุติโดยลูกค้า การยุตินี้จะมีผลโดยไม่กระทบต่อความเสียหายใด ๆ ที่ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) หรือผู้สืบทอดและ/หรือตัวแทนที่ได้รับมอบอำนาจอาจเรียกร้องจากลูกค้าเป็นการชดเชยสำหรับความสูญเสียที่เกิดขึ้นโดย ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และ/หรือผู้สืบทอดต่อผลจากการละเมิดเหล่านี้ ลูกค้าจะได้รับแจ้งทางอีเมลเกี่ยวกับการยุติหรือการยืนยันการยุติบัญชีของตน ข้อมูลที่เกี่ยวข้องกับลูกค้าจะถูกทำลายตามคำขอของลูกค้าหรือเมื่อสิ้นสุดระยะเวลาตามกฎหมายในปัจจุบันจากการยุติบัญชีของลูกค้า 8. ข้อตกลงกับลูกค้า เงื่อนไขการใช้งานเหล่านี้เป็นสัญญาที่ควบคุมความสัมพันธ์ระหว่างลูกค้าและ ฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) เงื่อนไขการใช้งานเหล่านี้จะเข้าแทนที่ข้อกำหนดก่อนหน้าทั้งหมดที่ไม่ได้อ้างถึงโดยชัดแจ้งและเป็นสิทธิ์และภาระผูกพันทั้งหมดของฟอเรนเนอร์ เฟรนด์ลี่ ไทยแลนด์ (Foreigner Friendly Thailand) และลูกค้าในส่วนที่เกี่ยวกับเนื้อหา หากข้อกำหนดหนึ่งข้อหรือมากกว่าในเงื่อนไขการใช้งานไม่สามารถบังคับใช้ได้ภายใต้กฎหมายหรือกฎระเบียบที่บังคับใช้หรือเนื่องจากคำพิพากษา ข้อกำหนดอื่น ๆ จะยังคงมีผลบังคับอย่างสมบูรณ์ ตามขอบเขตที่อนุญาตโดยคำพิพากษานั้น นอกจากนี้ การที่ฝ่ายหนึ่งฝ่ายใดไม่สามารถดำเนินการเกี่ยวกับการละเมิดโดยอีกฝ่ายหนึ่งในข้อกำหนดใด ๆ Friendly Thailand) อาจแก้ไขเงื่อนไขการใช้งานเหล่านี้ได้ตลอดเวลา การแจ้งลักษณะของการแก้ไขเหล่านี้จะถูกส่งไปยังลูกค้าทันทีที่มีการประกาศบนเว็บไซต์ การแก้ไขจะมีผลบังคับใช้หนึ่งเดือนหลังจากที่มีการประกาศบนเว็บไซต์ ในส่วนที่เกี่ยวกับลูกค้าที่ลงทะเบียนหลังจากการประกาศการแก้ไขบนเว็บไซต์ การแก้ไขเหล่านี้จะมีผลบังคับใช้ทันที เนื่องจากถือเป็นการยอมรับการแก้ไขเหล่านี้โดยชัดแจ้งจากการลงทะเบียนเป็นลูกค้า เมื่อมีการออกการแก้ไขให้กับลูกค้า ลูกค้าจะมีทางเลือกหลายทางดังนี้ 9.1 การซื้อที่ลูกค้าสมัครเป็นสมาชิกในตอนแรกจะยังไม่หมดอายุ ในกรณีนี้ ลูกค้าอาจเลือกที่จะปฏิบัติตามเงื่อนไขการใช้งานที่มีผลใช้บังคับในวันที่ลูกค้าซื้อครั้งแรกจนถึงการสิ้นสุดของการซื้อครั้งแรกดังนั้นลูกค้าจะได้รับเชิญให้ตรวจสอบเงื่อนไขการใช้งานที่มีผลบังคับใช้บนเว็บไซต์ 10. กฎหมายที่ใช้บังคับ เงื่อนไขการใช้งานเหล่านี้ถูกควบคุม ตีความ และนำไปใช้ตามกฎหมายไทย โดยภาษาอังกฤษเป็นภาษาที่ใช้ในการตีความ
