Introduction:

These Terms of Use are between Foreigner Friendly Thailand Co. Ltd, and any individual, or business that enters the web or mobile applications (hereinafter “you”, “your” or “Customer”).

Foreigner Friendly Thailand Co. Ltd, offers a platform for businesses to promote, advertise, and list their products and/or services, in exchange for payment.

Foreigner Friendly Thailand Co. Ltd, offers its applications as a resource for consumers to search, and connect, with businesses listed on the Foreigner Friendly Thailand applications either in a free, or paid capacity.

The Foreigner Friendly Thailand Application is a free download on the Apple Store and Google Play Console. There is no cost to download the application itself.

Please read these Terms of Use to participate, with Foreigner Friendly Thailand Co. Ltd, as a Business, or Consumer, customer, and join us in responsible Internet behavior and the provision of a quality Service. By accessing, browsing, or using this Site, you acknowledge that you have read and agreed to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you should not use or access this Site. Foreigner Friendly Thailand reserves the right to revise these Terms at any time by updating this posting. We suggest that you review these Terms each time you use the Site. Your use of the Site after the posting of changes will constitute your acceptance of any changes. By agreeing to these Terms, it also constitutes your agreement to the Site Privacy Policy. By accessing or using any part of the site, you accept, without limitation or qualification, these Terms. If you do not agree with any of the Terms set forth below, you may not use any portion of the site. Price information found on this site is subject to change without notice. Foreigner Friendly Thailand Co. Ltd, reserves the right to change these Terms of Use at any time without notice. We grant you a personal, limited, non-transferable non-exclusive, license to access and use the Site. We reserve the right, in our sole discretion and without notice to you, to revise the products and services available on the Site and to change, suspend or discontinue any aspect of the Site and we will not be liable to you, or to any third party for doing so. We may also impose rules for and limits on use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes.

By becoming a customer, either Business or Consumer, you agree to comply with these Terms of Use. If you do not accept these Terms of Use, you must not register for or use the Services. Registration for one or more Services and use of the Services implies the acceptance in full of these Terms of Use by the Customer.

1. Definitions

The words or terms used in these Services Terms of Use and beginning with a capital letter shall have the following meaning:

“Additional Services” refers to services provided by Foreigner Friendly Supply Partners.

“Unique Review System” refers to Foreigner Friendly Thailand’s review system.

“Fair Pricing policy” refers to Foreigner Friendly Thailand’s policy of no Dual Pricing.

“Purchase” refers to a purchase made giving access to our paid Services, for a limited period as specified in the specific product purchased by a customer.

“Customer(s)” refers to one (or all) user(s) of one or more Services that validly makes a Foreigner Friendly Thailand purchase, or, has access to any of the Services after registering free of charge, or paying for additional services and benefits on the Sites.

“Paid Service(s)” refers to all Paid Services available to Customers or Visitors.

“Supply Partner(s)” refers to all businesses supplying services to Foreigner Friendly Thailand’s customers.

“Affiliate” refers to businesses or individuals that promote via our Affiliate Program.

“Site(s)” refers to, individually or collectively, the Foreigner Friendly Thailand web and mobile applications.

“Upgrade” refers to the paid addition, at the request of a customer, of additional Services and benefits to its Purchase.

“Visitor(s)” refers to one or more user(s) accessing the website or application without registration.

“Report Dual Pricing Feature’ refers to the process implemented into the application for users to report the occurrence of Dual pricing by a business appearing on the site.

“Terms of Use” refers to this contract.

2. Access and Registration to Services

2.1. General terms of access and free registration

The cost of equipment (computer, software, telecommunications, etc.) enabling access to the Services as well as the cost of communication are the sole responsibility of the “Customer”.

All our content and communications are in English and Thai languages.

Downloading the Foreigner Friendly Thailand Application itself is free. It provides access to our web and mobile applications.

2.2. We reserve the right, temporarily or permanently, in whole or in part, to modify, suspend or discontinue the Application without notice for any reason without liability to you, except where prohibited by applicable law.

2.3. In addition, you acknowledge that the App is provided over the Internet and mobile networks and so the quality and availability of the App may be affected by factors outside our reasonable control. Accordingly, we do not accept any responsibility for any connectivity issues that you may experience when using the App. In addition, you acknowledge and agree that you (and not us) are responsible for obtaining and maintaining all telecommunications, broadband and computer hardware, equipment, and services needed to access and use the App, and for paying any data charges that may be charged to you by your network provider in connection with your use of the App. In the event you choose to share information from the App by utilizing SMS/text functionality, you acknowledge and agree that you (and not us) are responsible for paying any related fees that may be charged to you by your network or telecommunications provider.

2.4. Services features available to “Visitors” (non-registered) users:

· Access to web, and mobile applications, and view participating businesses information, including business profile and customer reviews.

· Be able to view ‘Discount Coupons’ and ‘Flash Sale’ promotions on offer by participating businesses.

2.5. To register and become a free account holder, anyone interested in the Services must be at least 13 years of age, meet the requirements for registration or access to the concerned Services, be legally able to contract, not be under guardianship or curatorship, have read and accepted these Terms of Use and the Privacy Policy and have completed all mandatory fields listed on the registration form, including the fields for the following personal information:

· Name

· Email Address

· Age

· Nationality

· Country of Residence

· Telephone Number

The Customer warrants that the information provided is accurate. The Customer agrees to Foreigner Friendly Thailand of any changes to the data provided at the time of registration.

Except in the event of Foreigner Friendly Thailand Co. Ltd.'s own wrongdoing, or technical failure of the Service(s), the Customer will be responsible for the use of its email address, or other identifiers by third parties, or actions, or statements, made through the Customer’s communications with Foreigner Friendly Thailand, whether fraudulent or not, and will indemnify and hold Foreigner Friendly Thailand harmless against any claims in this respect. Furthermore, Foreigner Friendly Thailand is not required and does not have the technical means to ensure the identity of the persons registering for its Services. If a customer has reason to believe that a person is using their personal information, that Customer must immediately inform Foreigner Friendly Thailand Co. Ltd.

Services features available to any Registered Customer (including Customers with free accounts):

· Access to web, and mobile applications, and view participating businesses information, including business profile and customer reviews,

· Be able to view ‘Discount Coupons’ and ‘Flash Sale’ promotions on offer by participating businesses.

· Ability to create a free profile, and, have access to, and use, the “Report Dual Pricing” feature.

2.6. A consumer customer may upgrade, at any time, to become a “Paid Customer” and access the following services and benefits:

Features available to Consumer Customers with a Paid Purchase:

· Access to web, and mobile applications, and view participating businesses information, including, business profile and customer reviews,

· View, Access, and redeem Discount coupons and Flash Sale promotions on offer by participating businesses.

· The ability to submit customer reviews, and star ratings after using the services, or purchasing the products of a participating business.

· Access to, and use of, the “Report Dual Pricing” feature.

To obtain a paid Purchase and gain access to all the features of the Site and Services accessible to it, the Customer must fill out their details and select and pay the applicable Upgrade to become a “Paid Customer”.

After having reviewed your personal data, your Purchase package, and method of payment, you, the Customer, must action payment. This last step formalizes the entering into the Purchase contract to the Services in accordance with these Terms of Use.

Input errors by the Customer, or member of the Foreigner Friendly Thailand Co. Ltd team, may be corrected at any time before, or after, the contract is submitted. By making your payment after checking the contents of the purchase and making any changes deemed necessary, you, the Customer, accept these Terms of Use in full without reservation.

Once payment is confirmed, Foreigner Friendly Thailand Co. Ltd, will also acknowledge receipt of the purchase by email as soon as it is confirmed. This email will include the invoiced amount and these Terms of Use containing Foreigner Friendly Thailand contact information.

In addition, any personal data contained through the Sites and saved by the Customer on its account are automatically deleted at the end of a two-year period after the account is unused unless otherwise requested by the Customer.

3. Use of Services

Once registered, the Free or Paid Customer will have access to the Services, in accordance with its registration, as outlined in the Terms and Conditions for, Business Customers, and Consumer Customers.

3.1. The obligations of Foreign Friendly Thailand

The purpose of the Services is to provide users of the Foreigner Friendly Thailand platform with:

A platform for which businesses can promote, and advertise their service/product offerings to, but not exclusively to, an English-speaking market.

Information and services of businesses that support, and subscribe to, Foreigner Friendly Thailand Co. Ltd.’s policy of no “Dual Pricing” and its, “Fair Pricing Policy.”

Foreigner Friendly Thailand also provide information and feedback from consumer customers, for other consumer customer’s and businesses, with its “Unique Review System”.

To the best of our ability, monitor any breach of the Foreigner Friendly Thailand “Fair Pricing Policy”, via the process of our, “Report Dual Pricing” feature.

The purpose of the Services also does not cover the verification of the actual identity of Customers or businesses when they connect to the Site or Mobile App or to control the content and information provided by Customers and/or Businesses of their services. Foreigner Friendly Thailand is not responsible for any failure of the Customers or Businesses to provide accurate information.

3.2. Customer’s obligations

The provisions of this Article also apply without prejudice to the Article entitled “Termination”.

As part of the use of the Services, the Customer agrees to comply with the laws of Thailand and respect third-party rights and the provisions of the Terms of Use.

3.3. General obligations

The Customer’s general obligations are as follows:

Conduct itself in an honest manner with respect to Foreigner Friendly Thailand Co. Ltd, and Businesses and all Customers.

Respect and not infringe on the intellectual property rights of the content provided by Foreigner Friendly Thailand and other Customers.

This includes the unauthorized use of any trademark including Foreigner Friendly Thailand and its Customers.

Not reveal any information about its private life the dissemination of which could be harmful to the Customer or its reputation.

Not post publicly any negative comment that could in any way be harmful to the reputation of the Customer.

3.4 Essential Obligations

The Customer’s Essential Obligations are as follows:

Not to provide incorrect or misleading information regarding their personal data.

Not to post, disclose, or disseminate in any form whatsoever information or content that has the effect of diminishing, disrupting, preventing the normal use of the Services, interrupting and/or slowing the normal flow of communications between Customers and Foreigner Friendly Thailand through the Services, such as software, viruses, logical bombs, mass mailing, etc.

Not to provide email addresses or phone numbers to Foreigner Friendly Thailand of other persons or publish or send any information referring to other persons without having obtained their prior consent.

Only the Customer may use its personal information to access the Services. In this regard, the Customer will not, without this list being exhaustive, communicate, disseminate, share, make accessible, in any way whatsoever, its account information (including email account details) to any third party. Should a Customer wish to provide access to their Foreigner Friendly Thailand account to a third party, included but not limited to a friend, colleague or relative, the Customer will do so at their own risk.

A breach of the Essential Obligations constitutes a serious breach by the Customer of its obligations. Without prejudice to the provisions of the Article entitled “Termination”, in the event a customer failing to fulfil one or more of these Essential Obligations, Foreigner Friendly Thailand may terminate the contract and permanently delete the Customer’s account(s) on the Site and Mobile App and Services without refund.

To use the Services in accordance with the purpose described in the Terms of Use.

4. Fees and Terms of Payment

4.1. Fees, terms, and conditions of payment

The use of Paid Services may only be made where the Consumer Customer Upgrades to become a Paid Customer or if a Business pays for advertising on the platform. Customers may make a Purchase via the payment method outlined, and on display, on the applicable payment page when making a purchase.

They must be the account holder and duly authorized to make such payment.

The fees and Booking Conditions for these various Paid Services are always available during the introduction or use of the Paid Service(s) to which the Customer wishes to subscribe as well as its (or their) respective rate(s).

Fees are quoted in Thai Baht. The purchase by a Customer is virtually instantaneous from the validation of the transaction by Bank Card.

5. Intellectual Property

5.1. Content disseminated on the Services

All Services names, trademarks, logos, graphics, animations, videos, and texts contained on the Sites and within the Services are the property of Foreigner Friendly Thailand Co. Ltd (unless otherwise attributed), and may not be reproduced, used, or displayed without the express authorization of Foreigner Friendly Thailand.

The rights of use granted to the Customer are limited to private and personal use as part of and for the duration of the registration for the Services. Any other use by the Customer is prohibited.

The Customer is prohibited from, among other actions, modifying, copying, reproducing, downloading, broadcasting, transmitting, commercially operating and/or distributing the Services, Site pages or the computer code of the Services and Sites, in any way whatsoever.

5.2. Content used and shared

Customers grant Foreigner Friendly Thailand Co. Ltd, a license to use the intellectual property rights arising from the content provided by Customers in, and connection with, their registration, and use of the Services. This license includes, but is not limited to, the right of Foreigner Friendly Thailand Co. Ltd, to reproduce, represent, adapt, translate, digitize, and use for the purposes of the Services, or sub-license the content provided by the Customer (information, images, description, etc.) on all or part of the Services (on the Site or Mobile App, by email) and in the mailing campaigns carried out by Foreigner Friendly Thailand Co. Ltd, and, in general, on all electronic communication media (email, SMS, MMS, WAP, Internet, mobile application) as part of the Services.

The Customer expressly authorizes Foreigner Friendly Thailand Co. Ltd to modify this content to comply with the graphic charter of the Services or other communication media referred to above, and/or to bring it into compatibility with its technical functionality or the formats of the media in question. These rights are granted worldwide and for the duration of the Terms of Use between the Customer and Foreigner Friendly Thailand. The Customer may not copy, reproduce, or otherwise make use of the content produced by other Customers, other than for the strict purposes of the use of the Services for personal and private purposes.‍

6.Warranties Liabilities and Representations.

6.1. Operation of Sites and Services

To use the Services, Customers must have the equipment, software, and parameters necessary for the correct operation of the services, including the latest version of an Internet browser with Session cookies permitted and acceptance of pop-ups.

Depending on your network configuration (protected by a firewall or proxy) the connection with our sites might not be possible.

Customers must have the abilities, materials and software required for the use of the Internet or the Services mobile application, if applicable, the Internet services, and acknowledge that the nature and constraints of the Internet do not guarantee the security, availability, and integrity of the transmission of data over the Internet or through mobile applications.

Foreigner Friendly Thailand Co. Ltd, does not guarantee that the Services will be able to be used if Customers use a “pop-up blocker” tool; in this case, this function must be disabled prior to the use of the Services.

Foreigner Friendly Thailand Co. Ltd, does not warrant that the Services will function properly if the Customer’s Internet service provider fails to provide an adequate level of service. Similarly, if applicable, the use of smartphone applications, whose use Customers have agreed on directly with the provider, requires Customers to have a smartphone and a satisfactory connection.

Under these circumstances, Foreigner Friendly Thailand Co. Ltd, is not responsible for any lack of functionality, lack of access, or poor conditions of use of the Sites, that would be attributable to equipment-related inadequacies, to the internal failures of Customers’ access provider, the overloading of the Internet network and for all other reasons external to Foreigner Friendly Thailand, which the Customer agrees are events of force majeure.

The operation of the Services may be interrupted momentarily due to maintenance, updates, or technical improvements, or to update the content and/or the way it is presented. To the extent possible, Foreigner Friendly Thailand will, if possible, notify their Customer prior to any maintenance operations or updates.‍

6.2. Information and content provided by Customers

Information provided by a Customer to Foreigner Friendly Thailand Co. Ltd must be accurate and true. A Customer may disclose information voluntarily and the consequences that disclosing this information may have on the Customer’s life or the lives of other Customers are the exclusive responsibility of the Customer in question. The Customer, on its own account, discloses and disseminates information, data, texts, content, and images that concern it through the Services.

Accordingly, the Customer waives the right to make any claim against Foreigner Friendly Thailand Co. Ltd, especially on the basis of the possible infringement of its image rights, honor, reputation or privacy of its private life, that may result from the distribution or dissemination of information that concerns it under the terms and conditions established in the Terms of Use, in particular the Privacy Policy, to the extent that the Customer has previously given its voluntary and express consent to such dissemination as a result of its registration with the Services and in application of the Terms of Use.

Foreigner Friendly Thailand Co. Ltd cannot be held liable for the accuracy or inaccuracy of the information and content provided by other Customers, visitors to the Sites and/or the Customer itself (and the consequences of reliance on any such information). Similarly, Foreigner Friendly Thailand Co. Ltd cannot be held liable for any content used by a Customer that may potentially constitute a breach of the rights, of one or more of the other Customers or third parties, where a Customer of Foreigner Friendly Thailand Co. Ltd can demonstrate that it: (i) was not informed by a Customer or third party, or about the content or the use, (ii) did not have actual or prior knowledge of the same or (iii) did not commit a breach in the performance of any of its contractual obligations which led to such content being used.

Foreigner Friendly Thailand Co. Ltd may only be held liable by a customer if there is proof that Foreigner Friendly Thailand deliberately and intentionally committed a breach of its obligations, and this breach has caused the Customer direct damage. Where appropriate, it will be Foreigner Friendly Thailand Co. Ltd.’s responsibility to demonstrate that it has not committed any intentional breaches in the performance of its contractual obligations. Foreigner Friendly Thailand Co. Ltd may not be held liable for any direct or indirect damage incurred by the Customer in the event the Customer causes the damage or the damage results from an event of force majeure.

The quality of the Services demanded by both Foreigner Friendly Thailand Co. Ltd and its Customers requires that Customers conduct themselves ethically and behave with respect for the rights of third parties, and the respect for the laws of Thiland and regulations in force. To meet this demand for quality, individual responsibility and ethics, Foreigner Friendly Thailand requests any Customer to report any data (photography, text, video), behaviors or comments made by another Customer that appear to be in violation of the laws and regulations in force, concerning the purpose of the Services, third-party rights, or public morals.

As a result, Customers acknowledge and accept that the data they provide, as well as their behavior or comments made through the Services, may be reported by other Customers or End Users and are subject to acts of moderation and/or oversight by Foreigner Friendly Thailand Co. Ltd based on objective assessment criteria. If Foreigner Friendly Thailand Co. Ltd’s investigation of a report reveals that a customer violated the laws and regulations in force or its contractual obligations, the provisions of the Terms of Use, in particular, item 8 entitled “Termination”, may be applied. Depending on the Customers’ behavior or the comments made by Customers, the monitoring team reserve the right to block a Customer that has been the subject of a complaint.

In the event Foreigner Friendly Thailand Co. Ltd is held liable based on a customer breach of its legal obligations or those under the Terms of Use, said Customer agrees to indemnify and hold Foreigner Friendly Thailand Co. Ltd harmless against any orders, and all legal costs issued against it resulting from the Customer’s breach of its obligations.

6.3. Links and external resources

Foreigner Friendly Thailand Co. Ltd is only liable for the hyperlinks it creates and does not exercise any control over the External Websites and external resources (third-party websites or mobile applications, social networks, etc.) to which the hyperlinks accessible on the Sites and the Services redirect and which Foreigner Friendly Thailand did not create. It cannot be held liable for the provision of hyperlinks to External Websites, and cannot be held liable for their content, advertisements, products, service features or any other information available on or based on the use of such External Websites.

Any issues relating to a link must be submitted to the administrator or webmaster of the site in question. A Customer’s access and/or use of these sources and External Websites may be governed by third party terms and conditions over which Foreigner Friendly Thailand Co. Ltd has no control.

Finally, if during using the Sites, the use of the Sites leads a customer to pages that include External Websites, pages, or forums whose title and/or content constitutes a violation of applicable law, that Customer is requested to terminate its use of the Sites, or navigation to, the External Website in question. Customers who continue to search, or navigate to, such External Websites proceed at their own risk, and Foreigner Friendly Thailand will not be liable for the content of External Websites.

6.4. Indemnity

You agree to indemnify us (including our directors, officers, employees, subcontractors, agents, and affiliates) against all third-party claims and liabilities related to your breach of this Agreement and/or to your use of the Services.

6.5. Limitation of Liability

You agree that you use the App and/or any Third-Party Sites at your own risk. You further understand and agree that we are not responsible or liable for your illegal, unauthorized, or improper use of information transmitted, monitored, stored or received using the App.

To the fullest extent permitted under applicable law, in no event shall we be liable to you personally for any loss, injury or damages (including but not limited to any special, indirect, consequential or punitive damages, lost profits, lost revenues or other incidental damages) arising out of the use, inability to use, or the results of use of the App.

7. Account Closure

Customers may request the closure of their Foreigner Friendly Thailand account at any time by contacting Foreigner Friendly Thailand Co. Ltd. This request will be deemed made on the working day following the receipt by Foreigner Friendly Thailand Co. Ltd of the request to close the account concerned and the account will be deleted no later than fourteen (14) days after the receipt of the request by Foreigner Friendly Thailand. This request will not entail reimbursement to the Customer of any kind.

8. Termination

Without prejudice to the other provisions of the Terms of Use, in the event of a serious breach of the Terms of Use by the Customer, Foreigner Friendly Thailand Co. Ltd will terminate the Customer’s account without prior notice or formal notice. This termination will have the same effect as the termination by the Customer.

This termination will take effect without prejudice to any damages Foreigner Friendly Thailand Co. Ltd, it’s, or their successors, and/or authorized representatives, may claim from Customers as compensation for losses incurred by Foreigner Friendly Thailand Co. Ltd and/or, its successors as a result of these breaches.

The Customer will be notified by email of the termination or confirmation of the termination of its account. Data relating to the Customer will be destroyed at the request of the Customer or at the expiry of the current statutory period from the termination of the Customer’s account.

9. Agreement with the Customer

These Terms of Use constitute a contract that governs relations between the Customer and Foreigner Thailand. These Terms of Use supersede all previous provisions not expressly referred to and constitute the entire rights and obligations of Foreigner Friendly Thailand Co. Ltd and the Customer with respect to their subject matter.

If one or more provisions in the Terms of Use are held to be unenforceable under applicable laws or regulations or because of a final decision, the other provisions will remain in full force and effect, to the extent permitted by that decision. Furthermore, the failure of a Party to act with respect to a breach by the other Party of any of the provisions of these Terms of Use does not in any way imply a waiver of the right to act later with respect to that breach.

10. Modification of the Services or Terms of Use

Foreigner Friendly Thailand may amend these Terms of Use at any time. Notice of the nature of these amendments will be sent to Customers as soon as they are posted on the Sites. The amendments will come into effect one month after they are posted on the Sites. With respect to Customers registering after the amendments are posted on the Sites, these amendments will immediately apply, as they will have expressly accepted them by becoming Customers. Upon the issuing of an amendment to a Customer, the Customer will have several options:

10.1. The Purchase initially taken out by the Customer has not yet expired

In this case, the Customer may choose to comply instead with the Terms of Use that were in force on the date that the Customer’s initial Purchase started until the expiry of that initial Purchase.‍

Customers are accordingly invited to always consult the version of the Terms of Use in force available on the Sites.

11. Applicable law

These Terms of Use are governed, interpreted, and applied in accordance with Thai law, with the English language being the language of interpretation. In the event of a dispute as to the meaning of a term or provision of these Terms of Use, Customers may contact Foreigner Friendly Thailand by emailing support@ffthai.com, making sure to indicate any personal identifiers including first name, last name, and email address.

Any disputes between Foreigner Friendly Thailand and a Customer, including any non-contractual disputes, arising from these Terms of Use or the Services that the Customer does not elect to settle by mediation as described above, will be subject to Thai Law.

Terms and Conditions for Businesses

In addition to agreeing to the above Terms of Use, Businesses subscribing to appear and promote their business on the platform agree to the following Terms and Conditions:

1. Fair Pricing Policy

1.1. By subscribing to appear on the web and mobile applications, businesses agree to strictly adhere to the Foreigner Friendly Thailand Co. Ltd “Fair Pricing Policy”.

Foreigner Friendly Thailand Co. Ltd “Fair Pricing “policy refers to the pricing policy of charging all customers the same price, for the same service, or product offering, regardless of the customers race, or nationality. The business should provide clear, unambiguous, transparent pricing across their respective platforms, venues, attractions, services and products.

This policy will be implemented for all members and strictly enforced. Any deviation or diversion from this practice could result in the suspension, and or cancellation of the member account. Such policy will be integrated into and become part and parcel to the ongoing marketing campaign for Foreigner Friendly Thailand Co. Whereas the standard, walk -in, displayed price, whether at the business premise, or on their website, for a particular product or service should be the same, pricing differences can occur under the following circumstances but should be clearly defined and advertised by the business, and again, must be consistent, and not discriminate against race or nationality.

· Group and corporate rates

· Membership Programs

· Third Party discounts and promotions

· Loyalty Programs

2.Report Dual Pricing Process

By subscribing to appear on the web and mobile applications, businesses agree to participate in the ‘Reporting of Dual Pricing Process’, structured into the application. Foreigner Friendly Thailand Co. Ltd, will only investigate a claim of Dual pricing if provided with evidence of the claim. If compelling evidence is provided to support the claim, then any business found to be in breach of this policy will be removed from the web and mobile applications at the discretion of Foreigner Friendly Thailand and the account terminated. Termination of the account will result in the forfeiture of any previous payment.

3.Reviews

By subscribing to appear on the web and mobile applications, businesses agree to participate in the Foreigner Friendly Thailand Co. Ltd unique Review System. The system for reviews, is designed for helping consumers make informed choices about the services they use, and, for the benefit of a business, for improving customer experience and quality of service.

Positive and Negative reviews will be submitted via two separate channels.

All ‘Positive’ reviews will be sent to the business for approval and will not be published until approval is granted. Only then, will the review be displayed publicly on the businesses profile. Businesses hold the right to reject a review from being displayed on their profile if they deem the content unacceptable.

In agreeing to these terms and conditions, businesses also agree to receive ‘Negative/Constructive’ feedback from consumer users. This feedback is private and is never displayed publicly. Its purpose is to encourage businesses to use this feedback to improve, and better their service/product offering in the future. The business agrees to not hold either Foreigner Friendly Thailand Co. Ltd, or any consumer member liable for any feedback obtained through this private process.

Businesses agree to discuss with their Foreigner Friendly Thailand CRM representative any issues relating to negative or constructive feedback.

4. Star Rating

4.1 Star rating commencement

Businesses agree to the process of adding a star rating once a minimum of 50-star ratings have been submitted. Consumers will be notified on the profile if the business is yet to reach 50-star ratings as an explanation for the absence of a star rating.

4.2 Calculation of star rating

Businesses agree that their star rating will be based on the average of the most recent 500 ratings submitted by consumers. Prior to reaching 500 ratings the star rating will be based on the average number of star ratings above 50 consumer submitted ratings.

5. Quality Control

By subscribing to appear on the web and mobile applications, businesses accept that Foreigner Friendly Thailand Co. Ltd, may use customer feedback to monitor quality control, and reserve the right to remove a business from the web and mobile applications, and the account subsequently be terminated, if the quality of service/product on offer continues to attract negative feedback and falls below acceptable service, of product standards. In this situation, the business will forfeit any previously made payment.

6. Information

6.1 Accuracy of information

All businesses enrolled in the "Foreigner Friendly Thailand" application program will provide correct and accurate information to be used in the promotion of their respective product, service, activity etc. Such information can and should be updated as necessary as it relates to special seasonal promotions and changes in marketing strategy.

The Customer agrees to immediately update or inform Foreigner Friendly Thailand Co. Ltd of any changes to the data provided at the time of registration.

6.2 Promotions

Businesses should provide what your marketing campaign and company policies states. No bait and switch or any illicit, illegal or unlicensed advertising activities, will be permitted and could result in the suspension and or cancellation of the membership account.

Promotions, discounts coupons or flash sales being offered must be clear and concise avoiding any ambiguous language so as not to complicate, confuse or mislead any potential clients both foreign and Thai.

Businesses must advise on their profile and/or discount coupons or flash sales, if a booking is required to secure a service.

6.3. Advertisement of Alcoholic beverages

All businesses enrolled in the "Foreigner Friendly Thailand" application program that engages in the sale of alcoholic beverages as part of their service/product offering, must fully comply with the Thai government implemented “Alcoholic Beverage Control Act, B.E. 2551 (2008) (“ABCA”)”. The Control Act must be especially observed, and adhered to, during the process of posting, discount coupons, flash sales and other promotions that could include alcohol related offerings.

Foreigner Friendly Thailand Co. Ltd will not be held responsible for any breach, a business on the platform, commits in regard to this government implemented act.

7. Membership

7.1 Membership Packages

Businesses can choose from a selection of membership packages on offer and should choose one that best meets with their business’s requirements. Custom packages can be made available for owners of multiple businesses, or branches. The type of package cannot be changed until the original membership package has expired and renewal of package is due.

7.2 Length of package

Unless otherwise stated a membership package will run for the duration of 12 months. Membership lengths can be extended at the discretion of Foreigner Friendly Thailand Co. Ltd.

7.3 Membership Fees

All membership fees are due on, or before, the expiration date of the contract. In the event a member account has expired, and renewal payment has not been made, said accounts will not be viewable to the public until such time that the account has been brought current.

Business members will be sent a renewal notice prior to the expiration of their current membership. Suspension of account is an automatic process within the system if payment has not been made by expiration date. Foreigner Friendly Thailand Co. Ltd will not be held responsible for any time the business does not appear live on the application.

8. Limitation of Liability

You agree that you use the App and/or any Third-Party Sites at your own risk. You further understand and agree that we are not responsible or liable for your illegal, unauthorized, or improper use of information transmitted, monitored, stored, or received using the App.

To the fullest extent permitted under applicable law, in no event shall we be liable to you personally for any loss, injury or damages (including but not limited to any special, indirect, consequential, or punitive damages, lost profits, lost revenues or other incidental damages) arising out of the use, inability to use, or the results of use of the App.

9. Distribution and use of content

9.1. By providing text, imagery, or video content for your profile listing, you are giving copyright permission and consent to Foreigner Friendly Thailand Co. Ltd to use the provided content within the boundaries of the Foreigner Friendly Thailand applications and, associated third party platforms, that are used for the purpose of promoting and advertising your business for the benefit of your business.

9.2. A ‘Virtual Tour” is a feature available to businesses that gives the ability to add additional imagery and video content of your business to better attract consumer users to your service/product offering. The content you provide will be uploaded to the Foreigner Friendly Thailand YouTube channel. The ‘Virtual Tour” for your businesses will be accessible to consumer members via a hyperlink to your content on our channel that is embedded into your business listing profile page. By providing imagery, or video content for your company’s, ‘Virtual Tour’ on your business profile listing, you are giving Foreigner Friendly Thailand Co. Ltd permission and consent to distribute this content via Foreigner Friendly Thailand’s YouTube channel for the purpose of promoting your business.

10. Additional Conditions

You agree:

(a) not to use the App in any unlawful manner, for any unlawful or criminal purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App;

(b) not to use the App to record, post or transmit any information that is defamatory, threatening, abusive, offensive, obscene, indecent, discriminatory or is otherwise objectionable or infringes on third party rights;

(c) not to use the App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users, or restrict or inhibit any other users from using the App (including by hacking or defacing the App); and

(d) not to collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running the App, including, without limitation, by using any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape," "data mine" or in any way gather the App content or reproduce or circumvent the navigational structure or presentation of the App without our prior written consent.

Terms and Conditions for Registered Consumer Members

In addition to agreeing to the above Terms of Use, Businesses subscribing to appear and promote their business on the platform agree to the following Terms and Conditions:

1. Fair Pricing Policy

1.1. Consumer users accept that Foreigner Friendly Thailand Co. Ltd will, to the best of our ability, monitor and control the effectiveness and adherence to, the Foreigner Friendly Thailand Fair Pricing Policy, by businesses participating on the platform.

1.2. Foreigner Friendly Thailand Co. Ltd “Fair Pricing “policy refers to the pricing policy of charging all customers the same price, for the same service, or product offering, regardless of the customers race, or nationality. The business should provide clear, unambiguous, transparent pricing across their respective platforms, venues, attractions, services, and products.

1.3. Foreigner Friendly Thailand Co. Ltd, registered users, reserve the right to utilize, at their discretion, the ‘Report Dual Pricing’ featured as explained in section 2.1. if they believe a business on the platform has engaged in the practice of dual pricing.

1.4. Foreigner Friendly Thailand Co. Ltd take no financial responsibility, and will provide no financial recompence, if a consumer member has been discriminated based on price and has been a victim of ‘Dual Pricing’ by a participating business on our platform. However, by completing the ‘Report Dual Pricing’ form, and submitting substantiating, compelling evidence, Foreigner Friendly Thailand Co. Ltd will take the necessary steps to investigate the claim and supporting evidence, and if the claim proves to be an accurate depiction of what has occurred then the business in question will be removed from the platform.

1.5. If an unregistered ‘guest user’ of the platform believes they have observed or has been a victim of ‘Dual Pricing’ by a participating business on our platform, and wish to report the infringement, they have access to the “Report Dual Pricing ‘feature. Appropriate investigation and action will be performed by Foreigner Friendly Thailand Co. Ltd.

2. Report Dual Pricing

2.1 Foreigner Friendly Thailand Co. Ltd has a zero tolerance for dual pricing on the platform. The Report Dual Pricing feature is designed to help monitor and control the discriminatory practice of charging foreigners more for the same product or service as a Thai national. All businesses appearing on the platform have been given a full understanding of the negative affect dual pricing has, and, as part of their terms and conditions have agreed to the Foreigner Friendly Thailand Co. Ltd Fair pricing Policy and the repercussions of breaching this agreement.

2.2. Registered consumer users, with both free, or, paid memberships, reserve the right to utilize this feature if they believe they have been a victim of pricing discrimination by one of the businesses on the platform.

2.3. Users accept that Foreigner Friendly Thailand Co. Ltd will only investigate a claim of dual pricing if sufficient evidence is provided together with their report.

2.4. Given sufficient, compelling evidence Foreigner Friendly Thailand Co. Ltd will take the necessary actions to remove any business breaching the condition of fair pricing from the platform.

3. Unique Review System

3.1 By registering on the web and mobile applications, consumers, at their discretion, agree to participate in the Foreigner Friendly Thailand Co. Ltd unique Review System. The system for reviews, is designed for promoting good experiences with businesses on the platform, helping other consumers make informed choices about the services they use, and protecting you, the consumer, from the strict defamation laws that exist in Thailand.

3.2. Positive and Negative reviews will be submitted via two separate channels. Reviews can only be submitted once a member’s use of the businesses services has been confirmed via a QR Code scan.

All ‘Positive’ reviews will be sent to the business for approval and will not be published until approval is granted. Only then, will the review be displayed publicly on the businesses profile. Businesses hold the right to reject a review from being displayed on their profile if they deem the content unacceptable. A minimum of a three-star rating must be submitted to leave a ‘Positive Review’.

To avoid potential legal action from Thailand’s Strict defamation laws, ‘Negative Reviews’, (constructive feedback) can be submitted by a registered consumer user, but are submitted direct to the business, and to Foreigner Friendly Thailand Co. Ltd. This feedback is private and is never displayed publicly. Its purpose is to encourage businesses to use this feedback to improve, and better their service/product offering in the future. Registered users can choose to leave this feedback anonymously. Foreigner Friendly Thailand’s customer relationship management team, work with the business following a negative review, to help mitigate repeat occurrences and maintain quality control. A negative review can be accompanied by any star rating the user chooses.

3.3. Registered users can submit a star rating without leaving a review

For this reason, it is important that users provide honest, and transparent feedback relating to their experience with a business participating on the Foreigner Friendly Thailand Co. Ltd platform.

6. Membership

6.1. Membership Packages

Consumers can choose from the selection of membership packages as outlined in the above Terms of Use section 2. Access and Registration to Services.

6.2. Purchase of Consumer membership

Consumers will have the option to purchase memberships direct from our web or mobile applications or, at discount rates, by retaining a membership via one of Foreigner Friendly Thailand’s affiliate or brand ambassadors. Any discount retained on initial purchase can be renewed at the same rate as original purchase direct from Foreigner Friendly Thailand Co. Ltd.

6.3. Length of package

Unless otherwise stated a membership package will run for the duration of 12 months.

6.4. Membership Renewal

For the benefit of the member, membership renewal is not an ‘Auto renewal’ process, and payment will not be taken without a manual renewal actioned by the member. All membership fees are due on, or before the expiration date on the membership. Members will be sent a renewal notification prior to the expiration of their current membership. In the event a paying member account has expired, then the account will revert to a standard user account without the additional benefits of a paid account until which time payment has been renewed.

7. Coupons and Flash sales

7.1. Only registered, paying members have access to collect and redeem discount coupons and Flash sales on offer by participating businesses.

7.2 A registered user must present a business with a time sensitive, QR Code coupon, to redeem their promotion.

7.3. Foreigner Friendly Thailand Co. Ltd does not take payments from consumer customers for the collection of coupons or flash sales, or the purchases they make for goods and services on offer by businesses on the platform. All payments are made directly with the participating businesses. Foreigner Friendly Thailand Co. Ltd do not take a commission from the business for any financial transaction that occurs between business and customer.

8. Limitation of Liability

You agree that you use the App and/or any Third-Party Sites, including participating businesses on the application, at your own risk. You further understand and agree that we are not responsible or liable for your illegal, unauthorized, or improper use of information transmitted, monitored, stored, or received using the App.
